French DGCCRF warns about the consequences of TPO ban

In a communication published on July 4, 2025, the General Directorate for Competition, Consumer Affairs and Fraud Control (DGCCRF) reminds operators of the obligations arising from the ban on Trimethylbenzoyl diphenylphosphine oxide (TPO) from September 1.

Diphenyl trimethylbenzoyl phosphine oxide (CAS No.75980-60-8, EC No.278-355-8, INCI: Trimethylbenzoyl Diphenylphosphine Oxide - TPO) has been banned for use in cosmetic products by Regulation (EU) 2025/877 (7th “CMR” Regulation), which will come into force on September 1, 2025.

The DGCCRF points out that this substance is currently only authorized for professional use in artificial nail preparations at a maximum concentration of 5%.
The control authority warns that the ban does not set any time limit for the disposal of stocks of products on the market, regardless of the stage at which they are held (manufacturers, wholesalers, retailers and professional users), and details the implications.

As of September 1, it will therefore be forbidden to:
• Market cosmetic products containing TPO
• Make these products available, including to professionals
• Use these products, particularly by professionals as part of their services (varnish application, manicure, etc.)

The DGCCRF invites all economic operators, including professionals using these products in their business, to anticipate this deadline and take all necessary measures to comply with the ban.
