Administrative simplification: what the European Commission is proposing for the cosmetics sector

On July 8, 2025, the European Commission published its “Omnibus” proposal to simplify “certain requirements and procedures for chemical products.” It provides for the amendment of three regulations, including CLP Regulation 1272/2008 and Cosmetics Regulation 1223/2009. Upcoming changes include pre-notification of nanomaterials, the CMR derogation process and the Ingredient Glossary.

The stated aim of the proposed “Omnibus” Regulation is, in the words of the Commission, to “reduce compliance costs and administrative burden for the chemical industry while ensuring strong protection of human health and the environment.”

As for the Cosmetics Regulation, it covers several points:
• An easier, faster procedure for including colorants, preservatives and UV filters in the Regulation’s annexes
• A clarification of the procedure for derogating from the CMR ban in Article 15 and the setting of deadlines for compliance
• The abandonment of the Ingredient Glossary and the reference to an “Internationally Recognized Nomenclature” in the Annexes to the Regulation, as well as for product labeling
• The discontinuation of the obligation to pre-notify nanomaterials six months before placing products containing them on the market

Inclusion of new substances in the annexes
An article (14a) is added to the text of the Regulation. It stipulates that a request for a substance to be used as a colorant, preservative or UV-filter may be submitted to the Commission if it is accompanied by scientific evidence showing that it can be used safely in cosmetic products.
