Proposal for CLH classification of pepper extracts

On March 26, 2025, the European Chemicals Agency (ECHA) published the harmonized classification and labeling (CLH) proposal submitted by Austria for pepper extracts, including essential oils.

Austria’s proposal covers extractives and their physically modified derivatives such as tinctures, concretes, absolutes, essential oils, oleoresins, terpenes, terpene-free fractions, distillates, residues, etc., obtained from Piper nigrum, Piperaceae.

Pepper extracts (CAS No.84929-41-9; EC No.284-524-7; INCIs: Pepper Nigrum Fruit Extract, Pipper Nigrum Seed Extract, Pepper Nigrum Fruit Oil, Pipper Nigrum Seed Oil…) are ingredients listed in Cosing, with various functions, including fragrance and perfuming agent.
These substances are not currently regulated by European Cosmetics Regulation 1223/2009, nor are they listed in Annex VI of European CLP Regulation 1272/2008.

Austria proposes to classify the substances as follows:
• Flam. Liq. 3, H226 - Flammable liquid and vapour.
• Skin Irrit. 2, H315 - Causes skin irritation.
• Eye Irrit. 2, H319 - Causes serious eye irritation.
• Skin Sens. 1, H317 - May cause an allergic skin reaction.
• Asp. Tox. 1, H304 - May be fatal if swallowed and enters airways.
• Aquatic Acute 1, H400 - Very toxic to aquatic life (M-factor=1).
• Aquatic Chronic 3, H412 - Harmful to aquatic life with long lasting effects.
