Discarded unsold products: consultation by the European Commission

As part of the implementation of Regulation (EU) 2024/1781 (the “Ecodesign” Regulation), the European Commission has just launched a four-week consultation on a draft text on the details and format for the disclosure of information on discarded unsold consumer products. Several categories of cosmetics are targeted.

EU rules for sustainable products identify the destruction of unsold consumer products as an environmental problem. To discourage this practice, Regulation (EU) 2024/1781 has enacted a number of provisions, including a requirement for companies to disclose information about unsold consumer products they dispose of.

The text put out to consultation specifies in particular: • The delimitation of the product types concerned
• The format for the disclosure of information

Products concerned

The text lists the product categories that must comply with the information obligation by their code in the Combined Nomenclature.
This list of 39 categories includes code 3401, which designates:
• Soap;
• Organic surface-active products and preparations for use as soap, in the form of bars, cakes, moulded pieces or shapes, whether or not containing soap;
• Organic surface-active products and preparations for washing the skin, in the form of liquid or cream and put up for retail sale, whether or not containing soap;
• Paper, wadding, felt and nonwovens, impregnated, coated or covered with soap or detergent.

The format

To be provided:
• Organisation name and disclosure period (equivalent to one financial year)
• Product information, reasons for discarding products and information …
