France : two “PFAS” decrees under consultation

Deux décrets "PFAS" en consultation

On August 7, France launched a consultation on two decrees implementing the law of February 27, 2025, “aimed at protecting the population from the risks associated with perfluoroalkyl and polyfluoroalkyl substances.” The first concerns the definition of the reduction trajectory for industrial facilities. The second sets the PFAS concentration values that trigger a ban on products containing them.

Law No. 2025-188 of February 27, 2025 has two main objectives: • monitoring of drinking water, in particular through a national plan for the gradual reduction of PFAS discharges from industrial facilities,
• the ban, as of January 1, 2026, on the manufacture, import, export, and marketing, whether for payment or free of charge, of certain products (particularly cosmetics) containing PFAS. The two decrees under consultation aim to define the specific terms and conditions for implementing these two provisions.

With regard to the ban on products containing PFAS, the draft decree defines the list of those that are exempt (which does not include cosmetics), as well as the residual concentrations of PFAS substances above which the ban applies.
These are defined, according to the text, in order to “reconcile the ban on PFAS with the technical realities of detection,”:
• For all PFAS measured by targeted analysis, excluding polymers, the threshold is set at 25 ppb
• for the sum of PFAS measured as the sum of targeted PFAS analyses, where applicable with prior degradation of precursors, excluding polymers, the threshold is set at 250 ppb
• For PFAS, including polymers, the threshold is set at 50 ppm
