On 8 July 2026, the European Commission notified a draft Regulation aimed, on the one hand, at prohibiting the use in cosmetics of substances classified as CMR under Delegated Regulation (EU) 2025/1222 (23rd ATP to the CLP Regulation), and, on the other hand, at introducing or amending restrictions applicable to several ingredients recently assessed by the SCCS.

The key points of the draft Regulation

• Firstly, this text transposes into the Cosmetics Regulation 1223/2009 the classifications of substances as carcinogenic, mutagenic or toxic to reproduction (CMR), adopted in Delegated Regulation (EU) No 2025/1222 (23rd CLP Amendment). Three ingredients, which were not defended by the industry, are therefore banned from 1 February 2027: ozone, nitrous Oxide and tetrahydrofurfuryl Methacrylate.
• Secondly, an “Ingredients Omnibus” takes account of the SCCS’ latest assessments to ban or restrict these substances, with a deferred date of application (12 months after the Regulation comes into force for products already on the market, and 24 months after for products made available on the market).
• Several of these ingredients have been added to Annex II of the Cosmetics Regulation: Benzophenone-1, Benzophenone-2, Basic Brown 16, Basic Blue 99, and prostaglandin-like substances.
• Cannabidiol and BHA have been included in Annex III, with the former limited to 0.19 per cent and the latter to 0.07 per cent.
• The restrictions on Hydroxyapatite (nano) have been increased from 10 per cent to 29.5 per cent for toothpastes and from 0.465 per cent to 10 per cent for mouthwashes.
