The fitness check of the Cosmetics Regulation from the point of view of the European Commission

The European Commission launched the fitness check of Cosmetics Regulation 1223/2009 on 21 February 2025. On the 24th, the CRCC (Congress on Cosmetic Regulation and Compliance), organised by ERPA (European Association of Responsible Persons in Cosmetics) in Brussels, was an opportunity for Sylwia Jaczewska, from the European Commission, to explain the process that initiated it and the spirit in which it will be carried out.

“Over the past two years, we have been talking about a targeted revision of the Cosmetics Regulation, and we wanted to focus on certain key issues,” began Sylwia Jaczewska. “Today, we are no longer talking about revision, but evaluation.”
The Commission representative went on to explain the reasons behind this change.

Why an evaluation?

An “old” text…
Firstly, the Cosmetics Regulation was adopted in 2009, and has been fully applicable for over 10 years. In the light of the guidelines on better regulation, the Commission must regularly assess the legislative texts to determine whether they are still fit for purpose. “Although the Cosmetics Regulation does not contain a review clause, we realised that it was high time to evaluate it,” Sylwia Jaczewska said.

… which requires more than a targeted revision…
“And it became clearer to us that we really needed to make this evaluation after our work on the targeted revision, as well as during the discussions with you and the public authorities, because we realised that there could be other areas to modify, and not just those we wanted to cover in the targeted revision, which was a response to the sustainability strategy.”
