Discarded unsold products: the details for the disclosure of information

As part of the implementation of Regulation (EU) 2024/1781 (known as the “Ecodesign Regulation”), the European Commission was required to define common details for the disclosure of information regarding discarded unsold consumer products and a common disclosure format. This has now been done, with the publication of Implementing Regulation (EU) 2026/2 on February 10, 2026.

In accordance with the [Ecodesign Regulation] (@@LINK-70039@@), companies that discard unsold consumer products or have them discarded are required to disclose information about them: number, weight, reason for disposal, etc.
This information must appear on an easily accessible page of the economic operator’s website, or be included in the sustainability information, with a link to this report provided on the website.

The products covered

They are designated by their code in the Combined Nomenclature.
Cosmetics are covered by a product category under code 3401, which includes:
• Soap
• Organic surface-active products and preparations for use as soap, in the form of bars, cakes, moulded pieces or shapes, whether or not containing soap
• Organic surface-active products and preparations for washing the skin, in the form of liquid or cream and put up for retail sale, whether or not containing soap
• Paper, wadding, felt and nonwovens, impregnated, coated or covered with soap or detergent

The format

It is defined in the annex to Regulation (EU) 2026/2.
