Publication of the French "PFAS" law

Law No.2025-188 of 27 February 2025 aimed at protecting the public from the risks associated with perfluoroalkylated and polyfluoroalkylated substances was published in the Official Journal of the French Republic on 28 February. It prohibits the use of PFAS in cosmetic products from 1 January 2026.

The ban on PFAS

This law amends Title II of Book V of the Environment Code by adding a Chapter IV, comprising two articles.

Article L. 524-1.
It prohibits, from 1 January 2026, the manufacture, import, export and placing on the market, whether in return for payment or free of charge, of any product containing perfluoroalkylated and polyfluoroalkylated substances, if they are:
• cosmtic products,
• ski waxing products,
• textile products for clothing, footwear and waterproofing agents for textile products for clothing and footwear, except when they are designed for personal protection and safety (in this case, the ban will apply from 1 January 2030).
This ban does not apply to products containing PFAS in concentrations less than or equal to a residual value to be defined by decree.

Article L. 524-2.
It sets out the conditions for investigating and recording breaches of this prohibition.

Secondly, this law amends the Public Health Code, inserting two new articles.
