Notification of the 24th ATP of the European CLP

On 27 November 2025, the European Union notified a draft Regulation which constitutes the 24th ATP (Adaptation to Technical and Scientific Progress) of the CLP (Classification, Labelling and Packaging of Substances) Regulation. It involves a total of 14 substances that can be used in cosmetics, including eight with a new CMR classification, which ultimately threatens their use in cosmetic products.

Key points of this notification

• This draft Regulation is based on the opinions issued by the Risk Assessment Committee (RAC) of the European Chemicals Agency (ECHA) between 30 November 2023 and 20 September 2024.
• It concerns a total of 14 substances that may be used in cosmetic products (listed in CosIng, not included in Annex II of the Cosmetics Regulation, which lists prohibited ingredients).
• Eight of these are classified as CMRs (lithium carbonate, lithium chloride, lithium hydroxide, Sodium EDTMP, Potassium EDTMP, Potassium bromide, Heliotropin, Tea tree oil), which, in accordance with Article 15 of Regulation 1223/2009, paves the way for a possible ban on their use in cosmetics, unless an exemption is granted after consultation with the SCCS (which has already been requested for Heliotropine and Tea Tree Oil).
• This draft Regulation is open for consultation until 26 January 2026. The Commission plans to adopt it in the first quarter of 2026, with implementation approximately 20 months later.
