On September 27, 2026, the European Directive No. 2024/825 enters into force. It amends the unfair commercial practices to include environmental claims.
This Directive specifically targets environmental claims in order to improve efforts to combat greenwashing and to ensure that consumers have access to “clear, relevant, and reliable information.”
The following are prohibited:
• generic environmental claims,
• claims that apply to the entire product or company when they actually concern only one aspect of the product or a specific activity of the company,
• claims asserting a neutral or positive environmental impact based solely on the offsetting of greenhouse gas emissions,
• the display of a sustainability label not based on a certification system or established by public authorities…
This also applies to claims referring to future environmental performance without clear, objective, publicly accessible, and verifiable commitments.
National Implementation
EU countries had until March 27, 2026, to transpose this directive into their national laws. For now, France, along with a number of other countries, has still not done so.
The DGCCRF
In early June 2026, the DGCCRF organized a webinar on the subject and warned that, although it has not yet been transposed into French law, companies should take Directive (EU) No. 2024/825 into account. Inspections are planned, initially for educational and informational purposes.
