
On 30 December 2025, Decree No.2025-1376 “on the prevention of risks resulting from exposure to perfluoroalkyl and polyfluoroalkyl substances” was published in the Official Journal of the French Republic. It will come into force on 1 January 2026.
This Decree is issued pursuant to Law No. 2025-188 of 27 February 2025, which established a ban on PFAS in several categories of products (including cosmetics) as of 1 January 2026.
It provides a definition of the perfluoroalkyl and polyfluoroalkyl substances covered by the ban, sets out the list of products exempt from the ban and defines the residual PFAS concentrations above which the ban applies.
Definition
PFAS are defined as “any substance containing at least one fully fluorinated carbon atom (CF3-) or methylene (-CF2-) atom, without any attached hydrogen, chlorine, bromine or iodine atoms.”
It is specified that the ban concerns the placing on the market of products containing PFAS, i.e. “the act of supplying a product or making it available to a third party for the first time, whether for payment or free of charge.” Any importation is considered to be equivalent to placing on the market.
Products exempt from the ban
This list includes certain types of personal protective equipment, waterproofing agents and sanitary textiles intended for medical use… Cosmetics are not included in this list and are therefore subject to the ban.
